GSTR-3A Notice: Meaning, Time Limit and How to Respond

GSTR-3A is a notice for non-filing of a required GST return, not a return you file. Find out why it is issued, the 15-day response period, and how to act when you receive it.

What is GSTR-3A?

Form GSTR-3A is an electronic notice to a return defaulter. The tax authorities use it to tell a registered person that a specified GST return remains unfiled. The notice identifies the GSTIN, return type and tax period and directs the taxpayer to furnish the overdue return. It is not a form for declaring turnover, tax or input tax credit.

A GSTR-3A notice should not be confused with GSTR-10, the final return following cancellation of GST registration, or GSTR-7, the return used by GST tax deductors. GSTR-3A is the notice that may follow a failure to furnish an applicable return.

Why is GSTR-3A Notice Issued?

Under Rule 68, a notice in Form GSTR-3A is issued electronically when a registered person fails to furnish a return covered by Section 39, 44, 45 or 52. Depending on the obligation, this can concern a periodic return, an annual return, a final return following cancellation or an e-commerce operator’s statement. The particular outstanding form and period are stated in the notice.

  • The applicable return was not filed by its prescribed due date.
  • The GST registration or cancellation status still creates a return-filing obligation.
  • The GST portal records the relevant tax period as pending.

Important: Not every late GST filing automatically means the same enforcement process applies. Read the return type and tax period named in your actual notice.

How to Respond to a GSTR-3A Notice

The usual corrective action is to file the return identified in the notice, not to upload a separate GSTR-3A return. Follow these steps:

  1. Verify the notice: Sign in to the official GST portal and look for the relevant notice under the notices/orders area. Confirm the reference number, GSTIN, return type, tax period and issue date.
  2. Check filing status: Review the GST returns dashboard for the period mentioned. If you believe it has already been filed, verify the acknowledgement and filing date.
  3. Prepare the outstanding return: Reconcile records relevant to that return and tax period. Work out applicable dues, interest and late fees, if any.
  4. File through the prescribed workflow: Furnish the pending return on the GST portal within the notice period and discharge liabilities as required.
  5. Keep proof: Save the notice, filed-return acknowledgement and payment records. Check the portal status subsequently.

If the notice looks incorrect, the return is already filed, or the system does not permit filing, check the portal records and contact GST helpdesk or a qualified GST practitioner rather than ignoring it.

GSTR-3A Notice Time Limit: What Does 15 Days Mean?

The prescribed notice asks the taxpayer to furnish the pending return within 15 days. It is a response period stated in the non-filer notice, not a separate regular due date for filing GSTR-3A. Consult the issue and service details on your notice and act promptly.

What Happens If You Ignore a GSTR-3A Notice?

If a return remains unfiled after the notice, the officer may initiate applicable proceedings. For returns covered by Section 39 or Section 45, Section 62 allows a best-judgment assessment based on available information. Late fees, interest and other statutory consequences may also apply according to the facts and the relevant legal provisions. The precise consequences depend on the return involved; do not assume that every type of GSTR-3A notice triggers identical assessment powers.

Can a GSTR-3A Notice Be Withdrawn?

The prescribed GSTR-3A notice states that it is deemed withdrawn when the specified return is filed before issuance of the assessment order. This does not itself waive applicable interest or late fees. If an assessment order has already been issued, the separate statutory rules for relief after subsequent filing must be checked.
