You have to file it on the GST portal or through a facilitation agency by the taxpayer, alongside different documents such as the duplicate of the Audited Accounts and Annual Return in form GSTR-9. Further, according to CBIC\u2019s CGST notification number 09\/2020 dated 16th March 2020, all foreign companies in the aircraft business (compliant with the applicable provisions and rules of the Companies Act, 2013) are excluded from the GSTR-9C requirement.<\/p>\n<p>Additionally, non-residents and those providing OIDAR services in India to unregistered people are absolved from submitting GSTR-9 and GSTR-9C.<\/p>\n<h3 id=\"h-what-s-the-due-date-for-filing-gstr-9c-and-why-is-it-necessary\">What\u2019s the due date for filing GSTR 9C, and why is it necessary?<\/h3>\n<p>You must file the GSTR-9C before 31st December of the year following the applicable financial year under audit. The due date can be extended by the Government if deemed necessary.<\/p>\n<p>The GSTR-9C statement works as a foundation for the GST authorities to confirm the accuracy of the GST returns recorded by the taxpayers. Consequently, the turnover, Tax paid, and <a href=\"https:\/\/mybillbook.in\/s\/gst-goods-and-services-tax\/input-tax-credit-gst\/\">ITC<\/a> earned on a particular GSTIN (or State\/UT) should be pulled out from the audited accounts of the association in general.<\/p>\n<p><strong>According to Notification No: 56\/2019 released on November 14, 2019, for financial years 2017-18 and 2018-19, the following changes were made:\u00a0<\/strong><\/p>\n<ul>\n<li>Details of turnover adjustments to be included in tables 5B to 5N are now optional, and adjustments (if any) that need to be reported can be included in Table 5O.<\/li>\n<li>A taxpayer may or may not fill the details of ITC reconciliation in tables 12B, 12C, and 14.<\/li>\n<\/ul>\n<p>The Reconciliation Statement is separated into five parts as follows:<\/p>\n<p><strong>Part-1:<\/strong>\u00a0Basic details \u2013 It consists of the financial year, GSTIN, Legal Name, and Trade Name. The taxpayer should also specify whether he is liable to audit under some other law.<\/p>\n<p><strong>Part-2:<\/strong>\u00a0Reconciliation of turnover mentioned in the Audited Annual Financial Statement with turnover mentioned in Annual Return (GSTR-9) \u2013 This reports the gross and taxable turnover announced in the Annual return with the Audited Financial Statements. Usually, the Audited Financial statements are at a PAN level. This may require the separation of the audited financial statements at the GSTIN level for reporting in GSTR-9C.<\/p>\n<p><strong>Part-3:\u00a0<\/strong>Reconciliation of tax paid \u2013 This segment requires GST rate-wise reporting of the tax liability that emerged according to the accounts and paid as reported in the GSTR-9 individually. Further, taxpayers must also disclose any additional liability arising out of unreconciled differences.<\/p>\n<p><strong>Part-4:<\/strong>\u00a0Reconciliation of Input Tax Credit (ITC) \u2013 This part focused on reconciling input tax credit taken and used by taxpayers as reported in GSTR-9 and the Audited Financial Statement.<\/p>\n<p>It must also include a detailed report of Expenses booked according to the Audited Accounts, with the breakup of eligible and ineligible ITC, and reconciliation of the eligible ITC with the amount claimed under GSTR-9. This declaration comes after the reversal of ITC claims (if any) are considered.<\/p>\n<p><strong>Part-5:<\/strong>\u00a0Auditor\u2019s recommendation on additional liability due to non-reconciliation \u2013 The Auditor should report any tax liability recognised through the reconciliation exercise and GST audit to be paid by the taxpayer. The distinction between both is that if the CA certifying the GSTR-9C didn\u2019t conduct the GST audit, he more likely than not based his assessment on the Books of Accounts audited by another CA in the reconciliation statement.
