One is “freelancers don’t need GST until they earn ₹20 lakh.” The other is “if your clients are in another State, you must register no matter what.” Both sound plausible, and each is partly right.

This guide explains how the rules actually fit together, using the Central GST (CGST) Act, 2017, the Integrated GST (IGST) Act, 2017, and the CBIC notifications that modify them. It focuses on freelancers who supply services (designers, developers, writers, consultants, editors and similar) rather than those selling physical goods.

The short answer

A freelancer who supplies only services is not required to register for GST until annual turnover crosses ₹20 lakh (or ₹10 lakh in the four special category States of Manipur, Mizoram, Nagaland and Tripura). Having clients in other States, or abroad, does not by itself force registration while you stay under those limits. Once you cross the limit, you must register, and from then on you charge GST on your invoices.

The detail that matters is how “turnover” is counted, which exceptions exist, and what you cannot do if you are not registered.

Rule 1: The turnover limit (Section 22, CGST Act)

Under Section 22, a supplier becomes liable to register when their aggregate turnover in a financial year exceeds ₹20 lakh. For suppliers in special category States the limit is ₹10 lakh.

Which States are “special category” for this purpose? Section 22 starts from the States listed in Article 279A(4)(g) of the Constitution and then carves some out: Jammu & Kashmir, Arunachal Pradesh, Assam, Himachal Pradesh, Meghalaya, Sikkim and Uttarakhand all use the ₹20 lakh limit. That leaves Manipur, Mizoram, Nagaland and Tripura at ₹10 lakh. The Act also lets the Government raise the ₹10 lakh limit up to ₹20 lakh for a State that asks for it, so it is worth checking the current notification for your State.

Two points that trip people up:

The limit is “exceeds,” not “reaches.” A turnover of exactly ₹20 lakh does not trigger the requirement; ₹20,00,001 does.

The limit is per PAN across India, not per State or per client. Under Section 2(6), “aggregate turnover” is computed on an all-India basis and covers more than just the invoices on which you charge GST.

What counts toward turnover

Aggregate turnover includes the combined value of:

your taxable supplies (the services on which GST would be charged),

exempt supplies,

exports of services, and

inter-State supplies by persons with the same PAN.

It leaves out the GST itself (central tax, State tax, UT tax, integrated tax and cess) and the value of inward supplies on which tax is paid under reverse charge.

The practical consequence: money from foreign clients counts toward the ₹20 lakh limit even though no GST is charged on it. If you track invoices in a spreadsheet or a billing software like myBillBook, keep domestic and export income in separate columns so you can see both the GST-liable figure and the total turnover figure.

Rule 2: The inter-State rule and its exemption (Section 24, CGST Act)

This is the source of most confusion. Section 24 lists categories of persons who must register regardless of the ₹20 lakh limit. The first is “persons making any inter-State taxable supply.” Read on its own, that sounds like any freelancer with a client in another State must register.

It does not work that way for services, because Section 23(2) lets the Government exempt categories of suppliers, and it has done so. Notification No. 10/2017-Integrated Tax (13 October 2017), as amended by Notification No. 03/2019-Integrated Tax (effective 1 February 2019), exempts persons making inter-State supplies of taxable services from registration if their aggregate turnover (all-India) does not exceed ₹20 lakh in the financial year, or ₹10 lakh for special category States, using the same State list as Section 22.

So a freelancer in Pune invoicing clients in Delhi and Bengaluru is, while within the limit, an inter-State supplier of services but is not required to register. The exemption applies to services. If you also sell goods across State lines, different rules apply.

Clients outside India

Under Section 7(5)(a) of the IGST Act, a supply by a supplier located in India where the place of supply is outside India is treated as an inter-state supply. Qualifying exports of services are therefore covered by the same exemption while turnover stays within the limit: registration is not mandatory just because your clients are abroad.

There is a practical catch, and it is the main reason many exporting freelancers choose to register anyway. Exports of services are zero-rated (no GST is payable on them), but the usual way to export without paying tax is to file a Letter of Undertaking (LUT), and refunds of GST paid on business expenses are available through the refund process. Both are available only to registered persons. An unregistered freelancer does not lose the right to export, but also cannot use those mechanisms.

The other Section 24 categories

Section 24 also covers casual taxable persons, non-resident taxable persons, input service distributors, persons required to deduct tax at source under Section 51, e-commerce operators, agents supplying on behalf of others, and certain overseas suppliers of online services. A typical freelancer will not fall into these.

Two deserve a word because they sometimes come up:

Selling through an online platform (Section 24(ix)). Section 24(ix) requires registration for suppliers who supply through an e-commerce operator that is required to collect tax at source. But Notification No. 65/2017-Central Tax exempts service suppliers using such a platform from this requirement while their turnover stays within the notified limits (₹20 lakh, or ₹10 lakh in special category States), except for the services covered by Section 9(5) of the CGST Act, which are specific notified categories and not typical freelance work. Getting clients through a freelancing platform therefore does not, by itself, force registration.

Reverse charge (Section 24(iii)). Section 24(iii) names persons required to pay tax under reverse charge. Whether this applies to a freelancer depends on exactly what is being bought, from whom, and which exemptions apply to that supply. It should not be read as “any reverse-charge transaction means you must register.” If you buy services from outside India or from a notified category of domestic supplier and are unsure, check before assuming either way.

Rule 3: If you are not registered, you cannot charge GST

Section 32(1) of the CGST Act says that a person who is not a registered person shall not collect any amount by way of tax in respect of a supply. In plain terms, an unregistered freelancer cannot add “GST @ 18%” to an invoice, however polite the request.

The invoice should simply show the fee for the services without GST. If a client asks for a GST invoice, the freelancer is either unable to issue one while unregistered, or can choose to register (see below).

Examples

(The ₹ figures below are illustrative. The 18% GST rate used in Example 2 is an assumption for illustration; confirm the rate applicable to your specific service.)

Example 1: Graphic designer in Pune. Fees of ₹14 lakh for the year, clients in Maharashtra, Delhi and Karnataka. Turnover is below ₹20 lakh, and the inter-State exemption for services applies. No registration is required, and she cannot charge GST.

Example 2: Developer in Guwahati. Domestic invoices of ₹16 lakh plus ₹7 lakh from clients in the US. Aggregate turnover includes exports, so it is ₹23 lakh. Assam uses the ₹20 lakh limit, so he has crossed it. He must apply for registration within 30 days of becoming liable (Section 25(1)). After registration, a domestic invoice of ₹50,000 would carry GST of ₹9,000 at 18%, for a total of ₹59,000. Exports of services are zero-rated, so no GST is charged on the US invoices, subject to the conditions for zero-rated exports.

Example 3: Content writer in Aizawl, Mizoram. Fees of ₹11 lakh. Mizoram is one of the four special category States with a ₹10 lakh limit, so she has exceeded it and must register (unless a higher limit has been notified for her State).

Example 4: Consultant in Delhi. Turnover of ₹9 lakh. A new corporate client asks for a GST invoice. He is not registered, so he cannot charge GST. He can explain that he is below the threshold, or register voluntarily under Section 25(3) if the client relationship justifies the compliance cost.

When registering voluntarily can make sense

Section 25(3) allows a person who is not required to register to do so voluntarily. Once registered, all the obligations of a registered person apply: tax invoices, returns, and so on. Reasons a freelancer might still choose to register include:

corporate clients that want to claim input tax credit and so need GST invoices,

foreign clients or platforms that ask for a GSTIN,

wanting to export under an LUT and claim refunds on GST paid on business expenses, and

wanting to recover GST paid on business purchases as input tax credit (a registered person is generally entitled to claim it, subject to the Act’s conditions).

The trade-off is real: registration brings monthly or quarterly return filing and invoice discipline, even if sales are modest.

What happens if you cross the limit and do not register

Section 25(1) requires a person liable to register to apply within 30 days of becoming liable. Failing to register when liable attracts a penalty under Section 122(1)(xi) of the CGST Act of ₹10,000 or an amount equal to the tax evaded, whichever is higher, in addition to the tax itself. The cleanest way to avoid this is to track turnover through the year rather than discovering the problem when filing income tax returns.

If you hire freelancers

For small businesses on the buying side, three practical points follow from the above:

A freelancer within the threshold will not (and legally cannot) charge you GST. Do not ask for a GST invoice from someone who is not registered.

Because no GST is charged, there is no input tax credit to claim on those payments. Budget on the fee itself.

If a freelancer says they are registered, ask for their GSTIN and confirm it is active on the GST portal before you pay GST on an invoice.

GST registration is separate from income-tax obligations such as TDS on professional fees. Being below the GST threshold does not remove any income-tax deduction obligation you may have as a payer.

Quick checklist

Add up your income for the year: domestic, inter-State and export services. That is your aggregate turnover.

Compare it with ₹20 lakh (₹10 lakh in Manipur, Mizoram, Nagaland and Tripura).

Under the limit and supplying services only? Registration is not required, even with clients in other States or abroad. Do not charge GST.

Over the limit? Apply within 30 days.

Need a GSTIN for a client, an export LUT or input credit? Consider voluntary registration.

Unsure about reverse charge, goods, or an unusual structure? Ask a qualified professional.

This article is general information based on the law as understood in October 2026.
